1. LEGAL APPLICABILITY & ACCEPTANCE
This Product Usage & Disclaimer Policy (“Policy”) forms an integral part of and must be read in conjunction with the Terms & Conditions, Privacy Policy, and Refund, Return & Exchange Policy of Parijat Blooms.
By purchasing, accessing, or using any of our Products/Services, you:
- Agree to be legally bound by this Policy
- Acknowledge the disclaimers, limitations, and obligations herein
- Accept usage at your own risk
This Policy shall be interpreted in alignment with:
- Clause 7 (No Warranties)
- Clause 8 (Limitation of Liability)
- Clause 11 (Indemnity)
of our Terms & Conditions.
2. MANDATORY PATCH TEST (STRICT CONDITION OF USE)
A patch test is compulsory and non-negotiable prior to first use.
- Apply a small amount to the inner elbow or behind the ear
- Wait a minimum of 24 hours
Do not use the product if any irritation, redness, itching, or discomfort occurs.
Legal Position:
Failure to conduct a patch test shall constitute:
- User negligence
- Violation of usage instructions
- Assumption of full liability by the user
Use of Parijat Blooms products constitutes an explicit agreement that the company shall not be held liable for any adverse outcomes arising from misuse, negligence, or failure to adhere to prescribed guidelines.
3. PRODUCT USAGE GUIDELINES
Unless explicitly stated otherwise, products are for external use only.
Avoid:
- Eye contact
- Contact with broken, irritated, or sensitive skin
In case of contact with eyes: Rinse immediately with water.
Additional precautions:
- Keep away from children and pets
- Users must strictly follow product labels, website instructions, and safety directions
Cross Reference: Any deviation shall fall under misuse as per Clause 8 & Clause 11 of the Terms.
4. AYURVEDIC / NATURAL PRODUCT CHARACTERISTICS
Parijat Blooms products are plant-based, vegan, Ayurvedic-inspired, and made using naturally derived ingredients. Therefore, variations in color, aroma, texture, and consistency are natural.
Products may:
- Darken or lighten over time
- Show sedimentation
- Exhibit mild fragrance shifts
Disclaimer: Such variations do not indicate defect or contamination; they are inherent to natural formulations.
5. STORAGE & HANDLING REQUIREMENTS
Users must store products in a cool, dry, hygienic environment. Keep away from direct sunlight, heat, and moisture.
Ensure containers are tightly sealed and not exposed to water. Use only clean, dry hands or tools.
6. SPOILAGE, CONTAMINATION & USER LIABILITY
Due to natural formulations, improper handling may lead to fungus/mold formation, product spoilage, or change in smell or texture beyond acceptable limits.
If observed:
- Immediately discontinue use
- Safely discard the product
Legal Disclaimer:
Such occurrences shall be deemed user-induced damage resulting from improper storage or contamination; accordingly, no refund, replacement, or liability shall arise.
7. RESULTS & PERFORMANCE DISCLAIMER
Product effectiveness varies from person to person. Results depend on skin/hair type, health conditions, and lifestyle factors. We do not guarantee specific results or time-bound outcomes.
This aligns with Clause 7 (No Warranties) of Terms & Conditions.
8. MEDICAL & COSMETIC DISCLAIMER (INDIA COMPLIANCE)
Products are classified as cosmetic / personal care products under applicable Indian regulations. They are not drugs or medicinal products and are not intended to diagnose, treat, cure, or prevent any disease. They are not substitutes for medical advice.
Users are advised to consult a medical professional if pregnant, nursing, or having allergies or dermatological conditions.
9. REGULATORY & AYUSH-STYLE POSITIONING DISCLAIMER
While formulations may be inspired by traditional Ayurvedic principles, products are not represented as classical Ayurvedic medicines unless explicitly stated. No therapeutic or medicinal claims are made unless legally compliant.
Compliance intent includes the Drugs & Cosmetics Act, 1940 (India) and applicable cosmetic labeling and safety standards.
10. INGREDIENT SOURCING & ETHICAL CLAIMS DISCLAIMER
Parijat Blooms is committed to vegan, plant-based formulations and ethical production. However, raw materials are sourced from third-party vendors and we rely on supplier declarations and certifications.
Legal Disclaimer:
In case of false claims, misrepresentation, or fraud by suppliers, Parijat Blooms shall not be held liable but will take corrective action including vendor replacement and legal proceedings where necessary.
11. LIMITATION OF LIABILITY (STRICT ENFORCEMENT)
In accordance with Clause 8 of Terms & Conditions, Parijat Blooms shall not be liable for allergic reactions, skin sensitivities, improper use or overuse, lack of patch testing, storage negligence, or indirect or consequential damages.
Maximum liability (if any) shall not exceed:
- Amount paid OR
- INR 1,000 (whichever is lower)
12. USER INDEMNITY (CROSS-ENFORCEABLE)
As per Clause 11 of Terms & Conditions, you agree to indemnify and hold harmless Parijat Blooms from any claims arising from misuse of products, failure to follow instructions, or negligence in handling or storage.
13. HYGIENE & SAFE USAGE PRACTICES
- Do not share personal care products
- Avoid contamination
- Do not dilute or mix products unless instructed
- Discontinue use upon irritation
14. SHELF LIFE & EXPIRY
Use products strictly within the stated expiry date. Post-expiry usage is at user’s sole risk. No liability shall arise for expired product usage.
15. POLICY UPDATES
We reserve the right to modify this Policy at any time. Updates shall be effective upon publication and are governed by Clause 18 (Amendments) of the Terms.
16. GOVERNING LAW
This Policy shall be governed by the laws of India and jurisdiction as defined under Clause 16 of Terms & Conditions (Mumbai courts).
